Suppliers should proactively protect against threats that may arise from customer-side vulnerabilities, particularly if a client’s system becomes compromised.

As the line between supplier and customer blurs, joint accountability under data protection laws necessitates well-defined contractual agreements concerning breach notifications, minimum security standards, and liability for data breaches. This collaborative approach is essential for risk assessment and incident response, especially for high-risk AI applications subject to the forthcoming EU AI Act.

With global regulatory frameworks for AI diverging—ranging from the strict EU AI Act to more lenient frameworks in the US and Asia—the possibility of compliance gaps is increasing. Smaller firms may face challenges accessing specialized AI expertise, but resources are available; organizations like the Information Commissioner’s Office (ICO) and the European Data Protection Board (EDPB) offer guidance, while government-supported initiatives are being developed to assist businesses in navigating these complexities.

AI is not merely an enhancement to existing IT infrastructure; it represents a multifaceted, adaptive system that transforms data handling practices, presenting new risks for potential breaches. Businesses and suppliers must work in concert—through procurement and beyond—to protect privacy and uphold trust.

As both the UK and EU pioneer AI-related data regulations, companies operating across borders must remain vigilant regarding emerging legislation in the US and Asia-Pacific regions, where AI adoption is rapid and governance is varied. In this fragmented landscape, proactive businesses will not wait for breaches to prompt action; they will build resilience and accountability before innovation outpaces regulatory responsibility.
